1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Equal Start Ltd website (“Website”), including participation in raffles, making donations, and account creation. By accessing or using this Website, purchasing raffle tickets, or making a donation, you agree to comply with these Terms. Please read them carefully.

2. Raffle Terms

  • Eligibility: Entry into raffles is open only to individuals aged 18 or older. By purchasing a raffle ticket, you confirm that you meet this age requirement.

  • Prizes: Prizes for each raffle will vary and are described in the relevant raffle section on the Website. Prohibited items (such as tobacco or firearms) are not offered as prizes.

  • Tickets: The maximum number of tickets and pricing for each raffle are outlined in the raffle description and may vary between raffles.

  • Payment: All raffle ticket purchases are processed securely using Stripe. By purchasing a ticket, you agree to comply with Stripe’s terms and conditions.

  • Draw Process: Raffle winners are selected randomly, and the draw is conducted transparently. The winning ticket number will be publicly announced, and winners will be notified privately via email within 28 days.

  • Claiming Prizes: Winners must claim their prize within 30 days of the draw date. If a prize is unclaimed within this period, Equal Start Ltd reserves the right to reallocate or redraw the prize.

  • Non-Transferable and Non-Exchangeable: Raffle prizes are non-transferable and cannot be exchanged for cash unless explicitly stated in the raffle description.

  • Non-Refundable: All raffle tickets are final. Please review your ticket details carefully before confirming payment, as refunds will not be issued for errors made during the purchasing process.

 

3. Donation Terms

  • Donation Method: Donations made through Equal Start Ltd are processed securely via Stripe. By donating, you agree to comply with the terms and conditions of our payment processor.

  • Tax Deductibility: Donations to EQUAL START LTD are not currently Tax deductible.

  • Non-Refundable: All donations are final. Please review your donation details carefully before confirming payment. Refunds will not be issued for errors made in the donation process, except in cases of transaction errors at our discretion.

  • Recurring Donations: If you choose to set up a recurring donation, you may cancel at any time through your account or by contacting support. Cancellations take up to 3 business days to process, and no refunds will be issued for donations made before cancellation is completed.

  • Donations Not Linked to Raffles: Donations made to Equal Start Ltd do not include raffle tickets or entries into raffles. Only direct raffle ticket purchases enter you into a raffle draw.

 

4. Website Use Terms

  • Account Creation: Users may create an account to participate in raffles, manage recurring donations, or receive updates. Users are responsible for maintaining the confidentiality of their login information.

  • User Conduct: You agree to use the Website for lawful purposes only and to avoid any conduct that could harm Equal Start Ltd or other users.

  • Content Submission: Users may not submit harmful, offensive, or misleading content on the Website. Equal Start Ltd reserves the right to remove content that violates these Terms.

  • Termination of Account: Equal Start Ltd reserves the right to terminate user accounts in cases of Terms violation.

 

5. Privacy

Your personal information will be collected, used, and stored in accordance with our Privacy Policy. By using this Website and providing your personal information, you agree to the terms of the Privacy Policy.

 

6. Limitation of Liability

Equal Start Ltd strives to ensure the accuracy and reliability of the Website but cannot guarantee it will be error-free or uninterrupted. We will not be liable for:

  • Technical Errors: Any indirect, incidental, or consequential damages arising from the Website, including issues with access.

  • User Errors: Mistakes in raffle ticket purchases or donation processing resulting from user input errors, such as incorrect information.

  • Cancellation Delays: Delays in processing cancellations or refunds.

  • Unauthorised Access: Damage resulting from unauthorised access to user accounts due to failure to secure login information.

In the event of any dispute, Equal Start Ltd's liability will be limited to the amount of the transaction in question.

All operations of Equal Start Ltd are conducted in accordance with Queensland’s Collections Act 1966, Collections Regulation 2008, and applicable charitable and non-profit gaming laws, including the Charitable and Non-Profit Gaming Act 1999, Charitable and Non-Profit Gaming Regulation 1999, and Charitable and Non-Profit Gaming Rule 2010. By participating in donations or raffles through this Website, you acknowledge our adherence to these regulations and agree to comply with the related terms.

 

8. Dispute Resolution

If any disputes arise from your use of the Website, donations, or participation in raffles, you agree to first contact Equal Start Ltd to seek a resolution. If the dispute cannot be resolved informally, it may be escalated to mediation or arbitration under Queensland law.
